Statement of Electronic Disclosure:
In this Consent, “Kikoff,” the “Company,” “we,” “us,” and “our” mean Kikoff Inc. together with its subsidiaries and affiliates, including Grant Money, LLC, Kikoff Lending, LLC, and Revive Solutions, LLC; “Services” means the Kikoff, Grant Money products, and any other products and services we offer, including those described in the Kikoff Master Terms of Service; and “Communications” means the Documents and any other disclosures, notices, statements, records, and contracts we provide or make available to you in connection with the Services, excluding oral communications and recordings. This Consent applies to all of your accounts with, and all Communications we provide in connection with, the Services.
In order to electronically review and retrieve the documents related to your accounts with the Company and delivered to you in connection with this request for consent (the “Documents”), you will first need to review and accept this Consent.
With your consent, the Company can deliver the Documents and other disclosures and contracts related to your accounts to you by displaying or delivering them electronically, and requesting that you print or download them and retain them for your records.
The Documents and other Communications covered by this Consent include, without limitation:
- this Consent;
- the Privacy Policy;
- the Kikoff Master Terms of Service and all other agreements that govern your accounts, together with all amendments, notices and other agreements that supplement them;
- any agreements relating to accounts you may establish with us in the future, together with all amendments, notices and other agreements that supplement them; and
- account statements, transaction histories, fee and fee-calculation statements, tax forms, and other reports.
This notice contains important information that you are entitled to receive before you consent to electronic records and electronic signatures in connection with your accounts with the Company. Please read this notice carefully and print or download a copy for your files.
After you have read this information, if you agree to receive and accept the Documents from the Company electronically, and if you agree to general use of electronic records and electronic signatures in connection with your accounts with the Company, please acknowledge your acceptance of this Consent by checking the box before you are able to continue with your application. In doing so, you are providing your affirmative consent to use electronic Communications. By checking the box, you are also confirming that you meet the system requirements described below, that you have demonstrated your ability to receive, retain, and view electronic documents on your access device, and that you have a current email address.
You have the right to withdraw this Consent at any time. To withdraw your Consent, contact us at the applicable email address listed below. Withdrawal of your Consent will take effect only after we have had a reasonable period of time to act on it. Withdrawing your Consent will not affect the legal validity or enforceability of any Communication we provided to you, or of any E-Signature you gave, before the withdrawal took effect.
You agree to print out or download the Documents when we advise you to do so and keep them for your records. If you have any trouble printing or downloading any of the Documents, you may contact us by email at notices@kikoff.com.
You may obtain a paper copy of any Communication at any time, free of charge, by contacting us at the applicable email address listed above and identifying the Communication you would like. We will not charge you a fee for a paper copy. Requesting a paper copy of a Communication is not a withdrawal of this Consent and will not affect your accounts.
If you wish to change your notification email address, you may do so within the mobile app, by logging in to your account through our website, or by email at notices@kikoff.com.
In order to access the Documents electronically, you must have:
- A computer or mobile device with an internet connection
- We support Android and current IOS platforms for both phone and tablets, and Safari and Chrome browsers.
- An email address
- Either a printer, hard drive or other storage device
You represent that you have the hardware, software, email address and capacities described above, and your ability to read this Consent demonstrates that you have the necessary hardware and software to receive Communications electronically.
You are responsible for the installation, maintenance and operation of your computer or mobile device, browser and software. The Company is not responsible for errors or failures resulting from any malfunction of your computer or mobile device, browser or software, and is not responsible for computer viruses or related problems associated with your use of an online system.
If the system requirements described above change in a way that creates a material risk that you will not be able to access or retain Communications electronically, we will notify you and give you the opportunity to withdraw this Consent without any fee or other consequence. The current system requirements are always available in the mobile app and on our website, and you should review them periodically.
Your consent does not mean that the Company must provide all Documents related to your accounts electronically. The Company, at its option, may deliver documents or otherwise communicate with you on paper if it chooses to do so. The Company may also require that certain communications from you be delivered to the Company on paper at a specific address.
You agree that your use of a keypad, mouse, touchscreen or other device to select an item, button, icon or similar act or action, or to otherwise provide us with instructions, or in accessing or making any transaction regarding any agreement, acknowledgement, consent, term, disclosure or condition, constitutes your signature (your “E-Signature”), acceptance and agreement as if actually signed by you in writing. You acknowledge that you are signing this Consent with your E-Signature. You agree that your E-Signature is the legal equivalent of your manual signature on this Consent and on any other Communication you sign using your E-Signature, and you consent to be legally bound by their terms and conditions. You also agree that no certification authority or other third-party verification is necessary to validate your E-Signature, and that the absence of any such certification or third-party verification will not in any way affect the enforceability of your E-Signature or of any resulting contract between you and the Company.
I have read the information about the use of electronic records, disclosures, notices, and email, and consent to use of electronic records for the delivery of documents, including disclosures and other notices, in connection with my accounts with the Company. I have been able to view this information using my computer and software. I have an account with an Internet Service Provider, and I am able to send email and receive emails with hyperlinks to websites and attached files. I also consent to the use of electronic records and electronic signatures in connection with my accounts with the Company in place of written documents and handwritten signatures.
